1. Introduction

Thank you for choosing BlueSky Jets and our mobile application, "Sapphire Access". These Terms & Conditions govern your access to and use of our website, mobile application, communications, and related private aviation services.

By accessing or using BlueSky Jets services, submitting a trip request, creating an account, communicating with us, or opting in to receive text messages, you agree to these Terms & Conditions. If you do not agree, please do not use our services.


2. Services

BlueSky Jets provides private aviation-related services, which may include trip request intake, quote coordination, itinerary support, booking assistance, customer communications, and related concierge or account services.

Flight options, pricing, aircraft availability, schedules, routing, and service details are subject to change and may depend on aircraft availability, operator approval, weather, airport conditions, regulatory requirements, crew availability, and other operational factors.


3. Account and User Information

You agree to provide accurate, current, and complete information when using our services, including your name, contact information, trip details, passenger details, and payment or billing information when applicable.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Please notify us promptly if you believe your account or information has been accessed without authorization.


4. Trip Requests, Quotes, and Availability

Submitting a trip request does not guarantee aircraft availability, pricing, acceptance, or booking confirmation. Quotes and trip options are provided for informational and coordination purposes and may expire, change, or be withdrawn.

A trip is not confirmed until all required approvals, documentation, payment arrangements, and confirmations have been completed and accepted by BlueSky Jets and/or the applicable aircraft operator or service provider.


5. Bookings, Payments, Cancellations, and Changes

Bookings, payments, deposits, refunds, cancellations, itinerary changes, and related fees may be subject to additional terms provided at the time of booking, in a quote, invoice, charter agreement, operator agreement, or other written confirmation.

You agree to review all booking documents, payment terms, cancellation terms, and trip details carefully before confirming a trip. Any requested changes to a confirmed trip may be subject to availability, approval, additional charges, or cancellation fees.


6. Communications

By using BlueSky Jets services, you agree that we may contact you using the contact information you provide, including by phone, email, app notification, or text message, for service-related communications. These communications may relate to your account, trip requests, quotes, bookings, itinerary updates, payments, documents, customer support, and other service-related matters.


7. SMS and Text Messaging Terms

If you provide your mobile phone number and opt in to receive text messages, you agree to receive transactional SMS messages from BlueSky Jets related to your account, trip requests, quotes, bookings, itinerary updates, payment or document reminders, and customer support communications.

Message frequency varies based on your activity, requests, and bookings. Message and data rates may apply. Consent to receive SMS messages is not a condition of purchase.

You may opt out of SMS messages at any time by replying STOP. After you reply STOP, you may receive a confirmation message, and we will stop sending SMS messages to your mobile number unless you opt in again.

Supported carriers are not liable for delayed or undelivered messages. BlueSky Jets does not sell, rent, or share mobile phone numbers, SMS opt-in data, or text messaging consent with third parties, affiliates, or lead generators for marketing or promotional purposes, except as necessary to provide the messaging service or as required by law.

9. Third-Party Services and Providers

BlueSky Jets may use third-party vendors, aircraft operators, payment processors, communications providers, hosting providers, analytics tools, customer support tools, or other service providers to deliver and support our services.

Third-party services may be subject to their own terms, conditions, policies, requirements, and limitations. BlueSky Jets is not responsible for the acts, omissions, availability, policies, or performance of independent third-party providers except as required by applicable law.

All content, branding, logos, designs, software, text, images, and other materials made available through BlueSky Jets services are owned by or licensed to BlueSky Jets unless otherwise stated. BlueSky Jets services are provided on an "as available" basis. While we strive to provide accurate and timely information, we do not guarantee that all information, quotes, availability, schedules, or service details will be error-free, current, uninterrupted, or complete.

Private aviation services may be affected by weather, maintenance, air traffic control, airport restrictions, regulatory requirements, security procedures, crew duty limitations, aircraft availability, and other factors outside our control.


13. Limitation of Liability

To the maximum extent permitted by law, BlueSky Jets will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages arising from or related to your use of our services, communications, trip requests, quotes, bookings, or inability to use the services.

Nothing in these Terms & Conditions limits liability that cannot be limited under applicable law.

You agree to indemnify and hold harmless BlueSky Jets and its owners, employees, representatives, contractors, and service providers from claims, losses, damages, liabilities, costs, or expenses arising from your misuse of the services, violation of these Terms & Conditions, or violation of applicable law.


15. Changes to These Terms & Conditions

We may update these Terms & Conditions from time to time. When we do, we will update the "Last Updated" date above. Your continued use of BlueSky Jets services after changes are posted means you accept the updated Terms & Conditions.


16. Governing Law

These Terms & Conditions are governed by the laws applicable to BlueSky Jets, without regard to conflict of law principles, unless otherwise required by applicable law.
